Website Terms & Conditions

The following Terms and Conditions govern your use of the Skyway Security (or "skywaysecurity.com") web site(s), as well as the materials accessible on or from the site(s). They contain exclusions of warranties and limitations of liability. Please read them carefully before entering the site, and refer to them as necessary as you explore the web site(s). Your access or use of the site means that you accept these Terms and Conditions even if you choose not to read them. Skyway Security reserves the right to revise these terms and conditions at any time by updating this posting. You should visit this page periodically to review these terms and conditions.

Use of Materials and Ownership

The information on this web site, along with any materials including without limitation text, publications, graphics, images, multimedia clips, HTML and java code, logos, banners, software, news releases, whitepapers, data sheets, product descriptions and FAQs, is the copyrighted work of Skyway Security and/or our suppliers and partners, and is protected under worldwide copyright laws and treaty provisions. Unauthorized use may violate copyright, trademark, and other laws. You may copy such materials so long as each copy (i) is solely for personal, informational, non-commercial use in support of Skyway Security products or services and is not modified, reproduced, displayed, publicly performed, distributed, or revised in any manner, (ii) plainly displays all copyright and other proprietary notices, in the same form and manner as on the original, including the URL of the source of the material and (iii) displays a statement that the materials are used solely with permission of Skyway Security. The use of the materials on any other web site for any purpose is prohibited.

Skyway Security trademarks may be used publicly only with written permission from Skyway Security and with proper acknowledgement. All other trademarks, brands, and names are the property of their respective owners. Except as expressly granted in this section (or to you specifically in writing), Skyway Security does not grant any express or implied right to you under any patents, copyrights, trademarks, trade secret information or other intellectual or proprietary rights.

Confidentiality

Those areas of the Skyway Security web site(s) which you access by using a password or other security device may contain proprietary and confidential information of Skyway Security and its suppliers, including without limitation engineering documents, manuals, software, program listings, product pricing, data file printouts, and other technical and marketing information. By accessing Skyway Security Confidential Information, you agree to keep this information confidential and to use the information solely for the purpose of maintaining and supporting your customers. You also agree to use reasonable care with this Confidential Information and to only disclose it within your company to employees who need to know it and who are instructed and agree not to disclose the information and not to use the information for any purpose not permitted by these Terms and Conditions. You will not alter, decompile, disassemble, reverse engineer, modify, or disclose to any third party any Skyway Security Confidential Information that you receive.

Skyway Security has attempted to provide accurate information on this web site as a service to you. However, we assume no responsibility for, and make no representations with respect to, the accuracy of the information. Skyway Security may change the programs or products mentioned on this web site at any time without notice. Mention of non-Skyway Security products or services is for your convenience and for information purposes only, and constitutes neither an endorsement nor a recommendation. Because international information is provided at this web site, not all products or programs mentioned will be available in your country. Please contact your local sales representative for information as to products and services available in your country.

Indemnity

You agree to indemnify Skyway Security and its officers, directors, employees and agents from and against any and all claims, demands, liabilities, costs, or expenses whatsoever, including without limitation reasonable legal fees and disbursements, resulting directly or indirectly from: (a) your access to or use of this web site or any web site to which this web site is or may be linked from time to time; (b) your use of, reliance on, or publication, communication or distribution of anything on or from this Site; or (c) your violation of any law or regulation.

Privacy

Skyway Security is committed to respecting your privacy. We recognize that when you choose to provide us with information about yourself, you trust us to act in a responsible manner. That's why we have put a policy in place to protect your personal information.

In order to personalize your web experience, we may at times require personal information from you, such as your user name or e-mail address, when you visit our site(s) as an anonymous visitor. We will not collect personally identifiable information unless you agree to provide it to us. Please do not submit your personally identifiable information to us if you do not want it to be collected and used. Skyway Security will not use personally identifiable information outside of the purpose for which it was provided unless otherwise approved by you.

Skyway Security may require business related information from you whether you visit our site(s) as an anonymous visitor or registered guest. We will not gather business related information unless you agree to provide it to us. This information will be used by Skyway Security to propose business solutions based on your requirements. Please do not submit your business information to us if you do not want it to be collected and used. We will endeavor to not use this information outside of the purpose for which it was provided unless otherwise approved by you.

To help us understand the preferences and trends of a typical user, and to help enhance the user experience, we may collect, during your session as either an anonymous visitor or registered guest, information that is not identifiable to you. Examples of this type of information include, but are not limited to:

· The domain name of the web site from which you linked to our site or online invitation

Subject to the restrictions described above, any information which you post to this web site, including e-mail submissions, will be considered non-confidential.

Cookies
Cookies are pieces of information placed on your hard drive after you visit web sites. Your browser manages the cookies. Cookies do not contain personally identifiable information. Skyway Security reserves the right to make cookies mandatory at times for certain purposes, including but not limited to:

If Skyway Security decides to change our privacy practices, we will post those changes on this page so that you are always kept informed of the data we collect, how we use it, and under what circumstances we disclose it. Please check this page for changes from time to time to make sure you are aware of our latest privacy practices and any other changes to these Terms and Conditions.

Because Skyway Security operates globally, we make the information we gather available to our worldwide business partners for the purpose for which it was collected. By using our web site and providing us with your personal data, you consent to this transfer of your personal data. However, subject to the foregoing, Skyway Security will not sell, rent, or share this information with any other organization.

If you have submitted information to the Skyway Security web site(s) and would like that information deleted from our records, please contact our Web Team info@skywaysecurity.com. We will use reasonable efforts to delete this information from our files.

Payment Options

Visa, MasterCard, & American Express with U.S. billing addresses are welcome. If you prefer, you may place your order online and phone in your credit card information toll free at 877-476-6607. You can also FAX your credit card information to (877) 369-4956. We also accept payment by Virtual Check. Virtual Check is an electronic data exchange that results in the producing of a paper check in the Skyway Security’s Office. You must have a U.S. based checking account to use Virtual Check. Using special software and the information you provide, you electronically authorize us to produce a legal check for this transaction only. Our software prints this check that we deposit into our account just as we would one you mailed us. The difference is time and effort. You don't need to buy a stamp, find an envelope, or take the mail to the post office. Instead of waiting days for the mail, we can process your payment in moments. You will then receive the check we produced, along with your other cancelled checks, in your normal bank statement.

Note: Please be sure to provide your exact billing address (the address your credit card bank has on file for you) when completing your order. Incorrect information will cause a delay or cancellation of your order.

If you wish to use a Visa or MasterCard credit cards issued outside of the US we reserve the right to request additional documentation be faxed to us. If we are unable to obtain billing information for your card, we will need you to fax us a photocopy of the front and back of your credit card along with one page of your credit card statement/bill which includes your billing address and account number, (we do not need to see any recent transactions you have made). Our fax number is 877-369-4956. If you are unable to do this you may also purchase using an American Express or check in advance in US dollars, or wire transfer.

We also will accept wire transfers, money orders, and cashier's checks in US dollars only. Orders are processed upon receipt of funds. Company checks for payment in advance will be held for 10 banking days after receipt for clearance of funds before the order is processed. We cannot guarantee the availability of a product by the time funds clear or payment is received. We will charge a $25 fee on all returned checks. Please email us for instructions on where to send checks or wire transfer information at info@skywaysecuirty.com.

Purchase Orders will be accepted from corporate accounts. A confirming copy of the PO is required via fax or mail before orders will be processed. Customers using purchase orders for the first time must call credit at 877-476-6607 or email info@skywaysecurity.com before initial order. Open account customers will be required to provide a credit card to be kept on file. We reserve the right to bill the credit card when an invoice is 60 days past the invoice date. 

Return Policy

All merchandise, except software and bulk cable, is eligible for a refund or exchange within 15 days from date of delivery. To return or exchange an item, you must obtain an RMA (Return Merchandise Authorization) number by filling out the return request form prior to shipping, please call for the link to the download area for the form. We will email you shipping instructions and issue a refund within 30 business days of when we receive the return. Shipping charges are the responsibility of the customer unless the return is the result of an error made by Skyway Security. We must receive the return no later than 10 business days after we send an RMA number. All products returned must be factory sealed, in original packaging and condition, and include all reference material, parts and packaging materials. An open box fee equal to 15% of the purchase price will be charged on any opened item. Some merchandise may be subject to a restocking fee of up to 30% of the purchase price. We reserve the right to refuse or return any package that does not comply with our Merchandise Return Policy. 

Warranty

All items carry a minimum 1 year warranty Digital Video Recorders 2 year warranty, or manufacturers warranty which ever is greater. The warranty covers labor to repair and/or parts replacement in the event of a manufacturing defect. Items needing repair may be returned to us or can be taken to the nearest manufacturers' authorized service center with a copy of your original sales receipt. If you choose to return the product to us for repair, you must obtain a Return Authorization number via email from our customer service department, info@skywaysecurity.com prior to shipping. No items will be accepted at our warehouse without proper authorization for return. 

Technical Support

We will be happy to answer any technical questions regarding products you have purchased by phone during normal business hours ( 9:30am – 5:30pm Monday through Friday ET) or by email. We are also available to answer questions regarding installation of the products we offer. Email to info@skywaysecurity.com

Shipping

All items are shipped via UPS or FedEx at our discretion unless otherwise specified by customer. We will try to accommodate special requests to the best of our ability. Shipping charges are based on package weight. Shipping is calculated with a direct link to UPS Online at time of order. Most products are shipped within 1 or 2 business days. Since we cannot control manufacturer's backorders on certain items, occasionally there will be a delay in shipment of your order. We will notify you of any delays via email. We ship from multiple warehouses across the US , therefore please allow 5 business days for all ground shipments. If products are needed sooner, air shipment is required.

Note: UPS/FedEx is not required to obtain a signature when delivering to a residential address. Please notify us if you wish to have UPS obtain a signature as delivery confirmation of your order. We will not be responsible for stolen shipments that were left at your door.

This Site may contain links to other sites as well as electronic mail links. These links are provided solely as a convenience to you. These other sites were independently developed by parties other than Skyway Security and Skyway Security assumes no responsibility for the accuracy or appropriateness of the information in such sites. The inclusion of any link to another site or mention of another party or its products or services on the linked site should not be construed as an endorsement of that party or its products or services. If you decide to access any linked site, you do so entirely at your own risk. Skyway Security reserves the right to terminate any link to this Site.

Software Licenses

All software that is made available for downloading from this Site is protected by copyright and may be protected by other rights. Your downloading and use of any such software is conditioned on your agreement to be bound by the terms of the software license agreement or designated legal notice accompanying such software.

Third Party Submissions

This Site may contain materials ("Third Party Content") submitted by other users. Skyway Security is not responsible for and does not represent or warrant the truthfulness, accuracy or reliability of any Third Party Content. Skyway Security is not responsible for screening or monitoring any Third Party Content posted by users of this Site. If notified of Third Party Content which allegedly breaches these terms and conditions, Skyway Security may investigate the allegation and determine in its sole discretion whether to remove or request the removal of the Third Party Content. Skyway Security has no liability for performance or non-performance of such activities. Any reliance on material posted by other users of the Site will be at your own risk.

General

These Terms and Conditions and the use of this web site shall be governed by the laws in force in the Province of Ontario, Canada without regard to the conflict of laws provisions therein. You irrevocably submit to the non-exclusive jurisdiction of the courts located in the Province of Ontario . You agree that the provisions of the United Nations Convention on Contracts for the International Sale of Goods shall not apply. If any provision hereof is held by a court of competent jurisdiction to be invalid, it shall be severed and the remaining provisions shall remain in full force without being invalidated in any way. The parties hereto are independent contractors. These Terms and Conditions are not intended to create a partnership, joint venture, or agency relationship between the parties. Except for any written agreements with Skyway Security that expressly reference these terms and conditions, this is the entire agreement between you and Skyway Security relating to the matters contained herein and shall not be modified except in writing by Skyway Security
